This Terms of Use is intended to bind rights and obligations between users, in accordance with the law 10.406/2002 (Civil Law), law 12.965/2014 (Brazilian Civil Rights Framework for the Internet) and other applicable laws.


iMusics S/A, Brazilian Register (CNPJ) 28.165.761/0001-12, is the owner and manager of the brand, website and mobile applications called iMusics.


By subscribing to or using our services (iMusics Services available via the web, mobile devices or TVs), you will be subject to the conditions described in this Term. You confirm that you have read and understood all the requirements described herein and that you accept and agree to abide by them. If you do not agree to (or can not keep), then you should not use or access our services.


To use our services you must be 18 years of age or older, or be 13 years of age or older and have the consent of your parents or guardian. You also affirm that any registration information you submit to us is true, accurate, and complete, and you agree to maintain such information at all times. Should the information provided doesn''t correspond to the criteria above your account will be blocked and it will be subject to our internal policies before being released.


From time to time, we may, at our discretion, make changes to this Agreement without notice. In this case, we will inform you through a notice on our website www.imusics.com or through emails, so be sure to carefully read any notice on our website, as well as always check your email and still visit our Policies and terms of use available on our website, listed above.


Our services are intended for all professionals working in the music ecosystem, directly or through the provision of services, however, we can also offer features that are aimed at people who simply enjoy music. Although we are a platform that offers free services, we can also offer paid subscriptions through a service identified as "Premium", or yet offer payment and receipt intermediation services and many other services. For paid services we may offer options of monthly or annual subscription and for the case of intermediations or other services, we will charge percentages per transaction. The options for managing signing and editing credit card or similar data can be found within the edition of your profile.


We provide a communication platform that enables members to communicate their profile, connect with each other and offer their services, manage them in many ways, and obtain useful and relevant information. We are not liable for any agreement, negotiation or transaction between members, online or offline, when performed outside the iMusics platform, that is, when payments are not processed by us.


Cancelling any of the services hired through iMusics should be done directly on the platform, under the option "My Negotiations" - available only to those professionals who choose to use the platform to sell their services. Either the CONTRACTOR or the CONTRACTING PARTY can cancel the deal and fees may apply. Those will be shown during the cancellation process.




Once you agree with the cancellation fees, refunds will always be done according to the payment method used when closing the deal.


  • Credit Card: The refund of the amount paid is made directly by the credit card operator and the amount will be credited to your next invoice.


All cancellation requests will be analyzed by our team to avoid impairment by both parties and it can take up to 5 (five) business days.


You acknowledge all services hired through iMusics are provided by independent third parties and they are not iMusics employees nor representatives of iMusics or its affiliates.


You may cancel a hired service since it has not been delivered. Cancelling a subscription can be done at any time and in some cases it may be charged for the period until the last day of the month in question.


Yet we may occasionally offer a free trial period so that you may know about the Premium profile services, in which case we may or may not request your credit card details. You agree that by the end of the trial period we may be able to start charging for the services automatically and on a monthly basis until you request the cancellation of the subscription in question, which may be done within the editing menu of your profile.


The iMusics Services and all content that we make available are owned by iMusics or some of the users found on iMusics. We grant you a limited, non- exclusive, revocable license to use our services. You promise and agree that you are using the Content for your personal use and that you will not redistribute any part of our services or our content.


iMusics software applications and all Content are licensed, not sold, to you, and iMusics and its licensors own all content and source code, even after installation on your personal computers, mobile phones, tablets, and / Or other relevant devices ("miscellaneous devices").


All iMusics trademarks, service marks, trade names, logos, domain names, and any other features are the exclusive property of iMusics or its licensors. The Agreements do not grant you any right to use any iMusics Brand Feature, whether for commercial or non-commercial use.


The iMusics Service is integrated with third-party applications, sites, and services to provide you with content, products and / or services, as well as various facilities, but those applications, sites, and services have their own policies and terms, and in that case, you You agree that we do not endorse and are not responsible for the behavior, resources or content of any third party, or for any transaction you may make that involves you. IMusics users will be able to post texts, photos, videos and music along with content (and may include other types of content). In this context the word "content" means any content posted on our platform.


You promise and undertake, with respect to any content that you enter into the iMusics platform, to comply with the following requirements:


  • You will have full rights to the content you are posting; And
  • The Content does not violate the Agreements, applicable law or intellectual property (including, but not limited to, copyright), publicity, personality, or other rights of others or implies any affiliation or endorsement of you or its content by iMusics or Of any artist, band, seal, entity or individual without the express written consent of such individual or entity.


iMusics may, but does not have the obligation to monitor, analyze, or edit user content. In all cases, we reserve the right to remove or disable a user's access or content for any reason, including, but not limited to content that, in the sole discretion of iMusics, violates existing agreements or impairs third parties and, in this scenario, we can provide, upon request, any data related to the offender. We may take such action without prior notice to you or any third party. Removing or blocking access to a profile or content should be in our sole discretion and we do not promise to remove or disable access to specific content.


You are solely responsible for all content you post. We are not responsible for the content and we do not endorse any opinion contained in any content. You agree that if anyone makes a complaint against iMusics relating to content you have posted under local law, you must compensate iMusics from any damages, losses and expenses incurred, of any kind, including lawyer fees, due to the aforementioned complaint or any other impairment, directly or indirectly related.


You grant us the right to provide you with advertising and other information and allow our certified users or business partners to do the same.


We may request from you via email or from our platform feedback, and you agree that if you provide feedback, ideas or suggestions regarding our services, your feedback is not confidential and you authorize us to use this feedback without restriction and without payment to You, so that our services can be improved.


You also grant us a non-exclusive, transferable, sublicenseable, royalty-free, life-long (or, in some jurisdictions where this is not permitted, for a duration equal to the duration of the Agreements of twenty (20) years), irrevocable , Fully paid and global to use, reproduce, make available to the public (for example, display or display), publish, translate, modify, create derivative works of, and distribute any of its content by any means, Combination with other content or materials, in any way and by any means, method or technology, is now known or created in the future. Not allowed:

  • Misuse any technology used by iMusics, its licensors or any third party;
  • Sell, rent, sublicense or lease any part of the iMusics services or its content;
  • Artificially increase the count of reproductions or otherwise manipulate the services using scripts or other manual or automated processes;
  • Remove or change any copyright, trademark or other intellectual property notices contained in or provided through our services; And
  • Provide your password to anyone else or use someone else's username and password;


It is also important to inform and request that you do not engage in any activity, publish any content or register and / or use a username that is or includes material that:


  • Be offensive, abusive, defamatory, pornographic, threatening or obscene;
  • It is illegal or intended to promote or commit an unlawful act of any kind, including but not limited to infringements of intellectual property rights, privacy rights or proprietary rights of iMusics or a third party;
  • Include your password or intentionally include the password of any other user or intentionally include personal data of third parties or is intended to request such personal data;
  • Include malicious content such as malware, Trojans or viruses, or otherwise interfere with any user's access to the Service;
  • Is intended to or causes bullying to other users;
  • Personifies or misrepresents your affiliation with another user, person or entity, or is fraudulent, false, misleading or otherwise deceptive;
  • Use automated means to artificially promote content;
  • Involve the transmission of unsolicited mailings or other forms of spam (spam), junk mail, chains or the like;
  • Involve commercial or sales activities such as advertising, promotions, contests, sweepstakes or pyramid schemes, which are not expressly authorized by iMusics and the responsible public bodies;
  • Is bound, mentions or otherwise promotes commercial products or services, except as expressly authorized by iMusics;
  • You interfere with, or otherwise discontinue, our services by tampering with, tampering with, or attempting to probe, sweep, or test the vulnerabilities in the Service or in the computing systems, network and usage rules of iMusics, or any of the security components, Authentication or any other protective measures of iMusics applicable to the Service, the Content or any part thereof; or
  • Conflicts with the Agreements, as determined by iMusics.


You confirm and agree that posting such content may result in immediate termination or suspension of your iMusics account.


We also care about your name, your image and your brand. Cloned and fake profiles have no space in iMusics. When identified, they are immediately removed. We also do not allow use of the words "oficial, official, real" as part of your username (your iMusics identifier or the username you are recognized on the platform).


According to our internal policies, reputed names have priority to its use, so when choosing your username we recommend that you take this into account. If you register a username that will be later claimed by who owns its rights or goes towards our internal validation policies, we will transfer the username to the right owner and give you new registration options. By using our services and our website or mobile and TV applications, you expressly agree with these conditions, having nothing to claim later.


Keep in mind that iMusics has social and interactive features, including the ability to post diverse content, share it, and make certain information about you available to the public. This shared or publicly available information may be used and shared again by other users in iMusics or the Internet, so we recommend that you keep an eye on that. We are not responsible for your choices to publish various content.


Remember that your password protects your user account and you are solely responsible for keeping your password confidential and secure. If you believe your password has been compromised, we recommend that you change it immediately.


If you have problems with your password or email, please send an email to recovery@imusics.com and let us know about your problem. This email mailbox is only for account recovery issues in iMusics and incoming emails will be answered on a first-come, first-served basis. Please note subjects not pertinent to this mail box will not be answered.


If you believe that a content infringes your intellectual property rights or other rights, use the "Report" option available in each of the iMusics posts. Your request will be reviewed by the responsible team and appropriate action will be taken.


We will use our best efforts to ensure that the service offered to you is always available, however, technical difficulties or maintenance may from time to time result in temporary interruptions. To the extent permitted by applicable law, we reserve the right, from time to time and at any time, to modify or discontinue, temporarily or permanently, functions and features of our services, with or without notice, without liability, except where prohibited By law, in relation to any interruption, modification or discontinuance of the services or any function or resource thereof. You understand, agree and accept that iMusics has no obligation to maintain, support or update our services. This section will apply to the extent permitted by applicable law.


If you create an iMusics account on behalf of a company, organization, entity or brand (Brand Account), whether it is reputed or not, the terms "you" and "your" as used throughout the Agreements apply To you and the Brand.


If you create a Trademark Account, you represent and warrant that you are authorized to grant all permissions and licenses provided in the Agreements and to link the Trademark to our Terms and Policies available on our website www.imusics.com.


We emphasize that we strive to provide the best service possible, but you understand and conclude that iMusics services are provided "as is" without any express or implied warranty, or condition of any kind. Use of our platform is at your sole risk and to the maximum extent permitted by applicable law, iMusics and all content owners make no representations and disclaim any warranties or conditions of quality. Unfortunately we cannot guarantee that our service is free of malware or harmful components. We do not further guarantee, endorse, guarantee or assume responsibility for any third party applications and their content, for the content of our users or for any product or service advertised and offered on the platform, in any way. You understand and agree that iMusics is not responsible for any transaction between you and any other party (ies). No information, whether verbal or written, obtained by you from iMusics will create any warranty on behalf of iMusics in that regard.


The use of our platform is at your own risk and to the maximum extent permitted by applicable law, iMusics and all content owners make no representations and disclaim any warranties or conditions of quality. Unfortunately we cannot guarantee that our service is free of malware or harmful components. We do not further guarantee, endorse or assume responsibility for any third party applications and their content, for the content of our users or for any product or service advertised and offered on the platform, in any way. You understand and agree that iMusics is not responsible for any transaction between you and any other party (ies). No information, whether verbal or written, obtained by you from iMusics will create any warranty on behalf of iMusics in that regard.


You agree that to the maximum extent permitted by applicable law, your sole and exclusive remedy for any problems or dissatisfaction with our service is to stop using our platform and disable your account. The same goes for third- party applications connected to our platform.


To the maximum extent permitted by law and under no circumstances shall iMusics, its officers, shareholders, employees, agents, directors, subsidiaries, affiliates, successors, assigns, suppliers or licensors be liable for any (1) indirect, special, incidental, exemplary or consequential; And (2) any loss of use, data, business or profits (direct or indirect) arising out of the use or inability to use iMusics services, or third party applications, irrespective of legal theory, unrelated to iMusics having been advised About the possibility of such damages, and even if a solution fails in its essential purpose.


This term supersedes any previous agreements in relation to the matters dealt with here.


Unless otherwise provided in the Agreements, if any provision of the Agreements becomes invalid or unenforceable for any reason or to any extent, such invalidity or enforceability shall in no way affect or render invalid or unenforceable the remaining provisions of the Agreements. Agreements, and the application of that provision shall be enforced to the extent permitted by law.


iMusics may assign the Agreements or any part thereof, and may delegate any of its obligations. You may not assign the Agreements or any part thereof, nor transfer or sublicense your rights under the Agreements to any third party.


To the maximum extent permitted by applicable law, you agree to indemnify and hold iMusics harmless from and against all damages, losses and expenses of any kind (including reasonable attorneys'' fees and costs) arising out of: (1) your violation of this Agreement; (2) any user content; (3) any activity you participate in or through the iMusics service (s); And (4) your violation of any law or the rights of a third party.


Unless required by mandatory law, the Agreements (and any non-contractual disputes / claims arising out of or in connection with them) are subject to the laws of Brazil. Accordingly, you agree that any dispute, claim or controversy arising in connection with the agreements will occur solely in Brazil, in the city of Sao Jose dos Campos - State of Sao Paulo.


In places where it is permitted, you and iMusics agree that each Party may make claims against the other only in its individual capacity and not as an applicant or a collective member of any alleged collective or representative action. Unless you and iMusics agree, no arbitrator or judge can consolidate claims of more than one person or otherwise preside over any form of a representative or collective proceeding. You also agree and agree that any lawsuit against iMusics may not, under any circumstances, have conviction values greater than R$ 1.000 (one thousand reais).
